Operation Mobilisation e.V. (bundan b\u00f6yle Organizat\u00f6r olarak an\u0131lacakt\u0131r) taraf\u0131ndan d\u00fczenlenen etkinliklere a\u015fa\u011f\u0131daki ko\u015fullarla herkes kat\u0131labilir<\/p>

(1) ilgili programa kat\u0131l\u0131m konusunda, kat\u0131lma hakk\u0131na sahip ki\u015fi grubu veya ki\u015fisel gereklilikler, \u00f6zellikle de fiziksel veya zihinsel yap\u0131, ya\u015f vb. bak\u0131m\u0131ndan herhangi bir k\u0131s\u0131tlama bulunmamas\u0131 ve<\/p>

S\u00f6zle\u015fmenin i\u00e7eri\u011fi yaln\u0131zca etkinli\u011fin duyurusu ve bu kat\u0131l\u0131m ko\u015fullar\u0131 ile belirlenir. S\u00f6zl\u00fc anla\u015fmalar, organizat\u00f6r taraf\u0131ndan yaz\u0131l\u0131 olarak teyit edilmedi\u011fi s\u00fcrece ge\u00e7ersizdir.<\/p>

\u00a7 2 \u00d6deme ko\u015fullar\u0131<\/strong><\/p>

Kat\u0131l\u0131m \u00fccreti, kay\u0131t \u00fccreti ve kalan kat\u0131l\u0131m \u00fccretinden olu\u015fmaktad\u0131r. Kay\u0131t b\u00f6l\u00fcm\u00fc ile bireysel duyuruda aksi belirtilmedik\u00e7e, kay\u0131t \u00fccreti ile birlikte kat\u0131l\u0131m \u00fccretinin tamam\u0131 derhal \u00f6denmelidir.<\/p>

\u00a0<\/p>

\u00a7 3 Hizmetlerde ve fiyatlarda yap\u0131lan de\u011fi\u015fiklikler<\/strong><\/p>

a) S\u00f6zle\u015fmenin imzalanmas\u0131ndan sonra gerekli hale gelen ve organizat\u00f6r taraf\u0131ndan iyi niyete ayk\u0131r\u0131 olarak ger\u00e7ekle\u015ftirilmeyen, s\u00f6zle\u015fmenin mutab\u0131k kal\u0131nan i\u00e7eri\u011finden m\u00fcnferit hizmetlerin de\u011fi\u015ftirilmesine ve sapt\u0131r\u0131lmas\u0131na, de\u011fi\u015fiklikler veya sapmalar \u00f6nemli olmad\u0131\u011f\u0131 ve rezerve edilen etkinli\u011fin genel karakterini bozmad\u0131\u011f\u0131 s\u00fcrece izin verilir. De\u011fi\u015ftirilen hizmetler kusurlu oldu\u011fu s\u00fcrece herhangi bir garanti talebi etkilenmeyecektir.<\/p>

b) Tur Operat\u00f6r\u00fc, s\u00f6zle\u015fmenin imzalanmas\u0131 ile kararla\u015ft\u0131r\u0131lan tarih aras\u0131nda 4 aydan fazla bir s\u00fcre olmas\u0131 ko\u015fuluyla, ula\u015f\u0131m maliyetlerinde veya liman veya havaalan\u0131 vergileri gibi belirli hizmetler i\u00e7in \u00fccretlerde bir art\u0131\u015f olmas\u0131 veya s\u00f6z konusu etkinlik i\u00e7in ge\u00e7erli d\u00f6viz kurlar\u0131nda bir de\u011fi\u015fiklik olmas\u0131 durumunda, ki\u015fi veya koltuk ba\u015f\u0131na art\u0131\u015flar\u0131n\u0131n fiyat\u0131 etkiledi\u011fi \u00f6l\u00e7\u00fcde, rezervasyonla birlikte teyit edilen reklam\u0131 yap\u0131lan fiyatlar\u0131 de\u011fi\u015ftirme hakk\u0131n\u0131 sakl\u0131 tutar. Tur fiyat\u0131ndaki de\u011fi\u015fiklik 5%'den fazlaysa, kat\u0131l\u0131mc\u0131 s\u00f6zle\u015fmeyi iptal edebilir veya organizat\u00f6r\u00fcn kat\u0131l\u0131mc\u0131 i\u00e7in ek maliyet olmaks\u0131z\u0131n kendi yelpazesinden kar\u015f\u0131la\u015ft\u0131r\u0131labilir bir etkinlik sunabilmesi durumunda e\u015fde\u011fer ba\u015fka bir etkinlik i\u00e7in yeniden rezervasyon talep edebilir. \u0130ptal veya yeniden rezervasyon talebi, organizat\u00f6r\u00fcn beyan\u0131n\u0131n al\u0131nmas\u0131ndan hemen sonra yap\u0131lmal\u0131d\u0131r. Bu yeniden rezervasyon imkan\u0131, bir etkinli\u011fin iptali durumunda da mevcuttur.<\/p>

\u00a0<\/p>

\u00a7 4 Kat\u0131l\u0131mc\u0131lar\u0131n geri \u00e7ekilmesi, yeniden rezervasyon, yedek ki\u015fi<\/strong><\/p>

a) Kat\u0131l\u0131mc\u0131, etkinli\u011fin ba\u015flang\u0131c\u0131na kadar herhangi bir zamanda, organizat\u00f6re yaz\u0131l\u0131 olarak yap\u0131lmas\u0131 gereken bir beyanla s\u00f6zle\u015fmeden \u00e7ekilebilir. Bu durumda, organizat\u00f6r yap\u0131lan d\u00fczenlemeler i\u00e7in makul bir tazminat talep edebilir. Her durumda, kay\u0131t \u00fccreti al\u0131konulacakt\u0131r. - Etkinli\u011fin ba\u015flamas\u0131ndan 35 g\u00fcn (5 hafta) \u00f6ncesinden itibaren: Fiyat\u0131n 50%'si<\/p>

- Etkinli\u011fin ba\u015flamas\u0131ndan 14 g\u00fcn (2 hafta) \u00f6ncesinden itibaren: Fiyat\u0131n 100%'si<\/p>

Etkinlikle ilgili di\u011fer tazminat talepleri bireysel davette veya onayda belirtilmedik\u00e7e.<\/p>

\u00a0<\/p>

\u00a7 5 Etkinli\u011fin organizat\u00f6r\u00fc taraf\u0131ndan iptal edilmesi<\/strong><\/p>

Organizat\u00f6r, a\u015fa\u011f\u0131daki durumlarda etkinlik ba\u015flamadan \u00f6nce s\u00f6zle\u015fmeden \u00e7ekilebilir veya ba\u015flad\u0131ktan sonra s\u00f6zle\u015fmeyi feshedebilir:<\/p>

a) Bildirimde bulunmaks\u0131z\u0131n<\/em><\/p>

Kat\u0131l\u0131mc\u0131, organizat\u00f6r\u00fcn uyar\u0131s\u0131na ra\u011fmen etkinli\u011fin uygulanmas\u0131n\u0131 \u0131srarla aksat\u0131rsa veya s\u00f6zle\u015fmenin derhal iptal edilmesini hakl\u0131 k\u0131lacak \u00f6l\u00e7\u00fcde s\u00f6zle\u015fmeye ayk\u0131r\u0131 davran\u0131rsa. Organizat\u00f6r s\u00f6zle\u015fmeyi bu \u015fekilde hakl\u0131 olarak feshederse, kat\u0131l\u0131m \u00fccretine ili\u015fkin hakk\u0131n\u0131 sakl\u0131 tutar; ancak, tasarruf edilen masraflar\u0131n de\u011ferini ve hizmet sa\u011flay\u0131c\u0131lar taraf\u0131ndan kendisine yat\u0131r\u0131lan tutarlar da dahil olmak \u00fczere, kullan\u0131lmayan hizmetin ba\u015fka herhangi bir \u015fekilde kullan\u0131m\u0131ndan elde etti\u011fi avantajlar\u0131 dikkate almal\u0131d\u0131r.<\/p>

b) Etkinli\u011fin ba\u015flamas\u0131ndan 2 hafta \u00f6ncesine kadar<\/em><\/p>

\u0130lan edilen veya resmi olarak \u00f6ng\u00f6r\u00fclen asgari kat\u0131l\u0131mc\u0131 say\u0131s\u0131na ula\u015f\u0131lamamas\u0131 durumunda, ilgili etkinli\u011fin ilan\u0131nda asgari bir kat\u0131l\u0131mc\u0131 say\u0131s\u0131 belirtilmi\u015fse.<\/p>

c) Di\u011fer iptal nedenleri<\/em><\/p>

Organizat\u00f6r, ne organizat\u00f6r\u00fcn ne de hizmet sa\u011flay\u0131c\u0131lar\u0131n\u0131n etkileyemeyece\u011fi veya sorumlu olmad\u0131\u011f\u0131 nedenlerle, \u00f6zellikle de m\u00fccbir sebeplerden dolay\u0131 gerekli olmas\u0131 halinde, etkinlikleri k\u0131sa s\u00fcre i\u00e7inde iptal etme hakk\u0131n\u0131 sakl\u0131 tutar. Kat\u0131l\u0131mc\u0131 iptal konusunda derhal yaz\u0131l\u0131, s\u00f6zl\u00fc veya telefonla bilgilendirilecektir.<\/p>

\u00a0<\/p>

\u00a7 6 Ola\u011fan\u00fcst\u00fc durumlar nedeniyle s\u00f6zle\u015fmenin iptali<\/strong><\/p>

S\u00f6zle\u015fmenin imzaland\u0131\u011f\u0131 tarihte \u00f6ng\u00f6r\u00fclemeyen m\u00fccbir sebepler nedeniyle etkinlik \u00f6nemli \u00f6l\u00e7\u00fcde zorla\u015f\u0131r, tehlikeye girer veya bozulursa, hem organizat\u00f6r hem de kat\u0131l\u0131mc\u0131 s\u00f6zle\u015fmeyi iptal edebilir. S\u00f6zle\u015fmenin feshedilmesi halinde organizat\u00f6r, s\u00f6zle\u015fmenin feshi sonucunda hizmetlerin art\u0131k kat\u0131l\u0131mc\u0131n\u0131n ilgisini \u00e7ekmemesi halinde, halihaz\u0131rda sa\u011flanm\u0131\u015f veya etkinlik sonunda sa\u011flanacak hizmetler i\u00e7in uygun bir tazminat talep edebilir. Ayr\u0131ca, organizat\u00f6r, \u00f6zellikle s\u00f6zle\u015fme d\u00f6n\u00fc\u015f ula\u015f\u0131m\u0131n\u0131 i\u00e7eriyorsa, kat\u0131l\u0131mc\u0131n\u0131n geri ta\u015f\u0131nmas\u0131 i\u00e7in gerekli \u00f6nlemleri almakla y\u00fck\u00fcml\u00fcd\u00fcr. D\u00f6n\u00fc\u015f nakliyesi i\u00e7in ek masraflar taraflarca e\u015fit olarak kar\u015f\u0131lanacakt\u0131r. Aksi takdirde, ek masraflar kat\u0131l\u0131mc\u0131 taraf\u0131ndan kar\u015f\u0131lanacakt\u0131r.<\/p>

\u00a0<\/p>

\u00a7 7 Sorumluluk<\/strong><\/p>

a) Organizat\u00f6r, s\u00f6zle\u015fme ile kararla\u015ft\u0131r\u0131lan hizmetlerin ilgili var\u0131\u015f \u00fclkesi veya yerinin yerel geleneklerine uygun olarak sa\u011flanmas\u0131ndan sorumludur. Organizat\u00f6r, yaln\u0131zca harici hizmetler olarak d\u00fczenledi\u011fi ve etkinlik a\u00e7\u0131klamas\u0131nda a\u00e7\u0131k\u00e7a harici hizmetler olarak belirtilen hizmetlerden sorumlu de\u011fildir. Bu sorumluluk s\u0131n\u0131rlamas\u0131, yerel y\u00f6netimin b\u00f6yle bir etkinli\u011fe kat\u0131lmas\u0131 durumunda da ge\u00e7erlidir.<\/p>

b) Bedensel yaralanma s\u00f6z konusu olmad\u0131\u011f\u0131 s\u00fcrece, organizat\u00f6r\u00fcn s\u00f6zle\u015fmeden do\u011fan taleplere ili\u015fkin sorumlulu\u011fu, kat\u0131l\u0131mc\u0131ya verilen zarar\u0131n kas\u0131tl\u0131 veya a\u011f\u0131r ihmal sonucu meydana gelmedi\u011fi ve organizat\u00f6r\u00fcn kat\u0131l\u0131mc\u0131n\u0131n yaln\u0131zca bir hizmet sa\u011flay\u0131c\u0131n\u0131n kusuru nedeniyle u\u011frad\u0131\u011f\u0131 zarardan sorumlu oldu\u011fu durumlarda, etkinlik fiyat\u0131n\u0131n \u00fc\u00e7 kat\u0131 ile s\u0131n\u0131rl\u0131d\u0131r.<\/p>

c) Organizat\u00f6r\u00fcn sorumlulu\u011fu, hizmet sa\u011flay\u0131c\u0131 taraf\u0131ndan sa\u011flanacak hizmetler i\u00e7in ge\u00e7erli olan yasal d\u00fczenlemeler veya uluslararas\u0131 anla\u015fmalar nedeniyle bir hizmet sa\u011flay\u0131c\u0131n\u0131n sorumlulu\u011fu da hari\u00e7 tutuldu\u011fu veya s\u0131n\u0131rland\u0131r\u0131ld\u0131\u011f\u0131 \u00f6l\u00e7\u00fcde hari\u00e7 tutulur veya s\u0131n\u0131rland\u0131r\u0131l\u0131r.<\/p>

\u00a7 8 \u0130\u015fbirli\u011fi yapma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc<\/strong><\/p>

Kat\u0131l\u0131mc\u0131, hizmette herhangi bir aksama olmas\u0131 durumunda yasal h\u00fck\u00fcmler \u00e7er\u00e7evesinde i\u015fbirli\u011fi yapmak, herhangi bir zarar\u0131 \u00f6nlemek veya asgari d\u00fczeyde tutmakla y\u00fck\u00fcml\u00fcd\u00fcr. Kat\u0131l\u0131mc\u0131 \u00f6zellikle her t\u00fcrl\u00fc \u015fik\u00e2yeti derhal yerel y\u00f6netime bildirmekle y\u00fck\u00fcml\u00fcd\u00fcr. Yerel y\u00f6netime, m\u00fcmk\u00fcn oldu\u011fu \u00f6l\u00e7\u00fcde, d\u00fczeltici \u00f6nlemler almas\u0131 talimat\u0131 verilecektir. Kat\u0131l\u0131mc\u0131 kusurlu bir \u015fekilde bir kusuru bildirmezse, indirim talebi do\u011fmayacakt\u0131r.<\/p>

\u00a7 9 Taleplerin hari\u00e7 tutulmas\u0131 ve zamana\u015f\u0131m\u0131<\/strong><\/p>

Kat\u0131l\u0131mc\u0131, etkinli\u011fin s\u00f6zle\u015fmeye uygun olarak ger\u00e7ekle\u015ftirilmemesine ili\u015fkin taleplerini, etkinli\u011fin s\u00f6zle\u015fmeye uygun olarak sona ermesinden itibaren bir ay i\u00e7inde organizat\u00f6re kar\u015f\u0131 ileri s\u00fcrmelidir. Son tarihin sona ermesinden sonra, kat\u0131l\u0131mc\u0131 yaln\u0131zca kendi kusuru olmaks\u0131z\u0131n son tarihe uymas\u0131n\u0131n engellenmesi durumunda talepte bulunabilir. Kat\u0131l\u0131mc\u0131n\u0131n s\u00f6zle\u015fmeye dayal\u0131 talepleri iki y\u0131l sonra zaman a\u015f\u0131m\u0131na u\u011frar. Zaman a\u015f\u0131m\u0131 s\u00fcresi, s\u00f6zle\u015fmeye g\u00f6re etkinli\u011fin sona ermesi gereken g\u00fcnden itibaren ba\u015flayacakt\u0131r. Kat\u0131l\u0131mc\u0131n\u0131n bu t\u00fcr taleplerde bulunmas\u0131 halinde, zaman a\u015f\u0131m\u0131 s\u00fcresi organizat\u00f6r\u00fcn talepleri yaz\u0131l\u0131 olarak reddetti\u011fi g\u00fcne kadar ask\u0131ya al\u0131n\u0131r. Hukuka ayk\u0131r\u0131 eylemlerden kaynaklanan talepler, zarar\u0131n \u00f6\u011frenilmesinden itibaren \u00fc\u00e7 y\u0131l sonra ve zarar veren taraf\u0131n y\u0131l sonunda zaman a\u015f\u0131m\u0131na u\u011frar.<\/p>

\u00a7 10 Pasaport, vize, g\u00fcmr\u00fck, kambiyo ve sa\u011fl\u0131k d\u00fczenlemeleri<\/strong><\/p>

Kat\u0131l\u0131mc\u0131, ilgili etkinlik \u00fclkesinin pasaport, vize, g\u00fcmr\u00fck, kambiyo ve sa\u011fl\u0131k d\u00fczenlemelerine uymakla y\u00fck\u00fcml\u00fcd\u00fcr. Kendisi de bu d\u00fczenlemeler hakk\u0131nda bilgi sahibi olmaktan sorumludur. Organizat\u00f6r taraf\u0131ndan g\u00f6nderilen herhangi bir belgenin do\u011fru veya eksiksiz oldu\u011fu iddia edilemez. Bu d\u00fczenlemelere uyulmamas\u0131ndan kaynaklanan t\u00fcm dezavantajlar, bu d\u00fczenlemeler rezervasyondan sonra de\u011fi\u015ftirilse bile kat\u0131l\u0131mc\u0131 taraf\u0131ndan kar\u015f\u0131lanacakt\u0131r.<\/p>

\u00a7 11 Sigortalar<\/strong><\/p>

Sigorta poli\u00e7esi yapt\u0131rmak kat\u0131l\u0131mc\u0131n\u0131n sorumlulu\u011fundad\u0131r. T\u00fcm kat\u0131l\u0131mc\u0131lar\u0131n seyahat iptal sigortas\u0131, bagaj sigortas\u0131 ve kaza sigortas\u0131 yapt\u0131rmalar\u0131 tavsiye edilir. Yurtd\u0131\u015f\u0131ndaki etkinlikler s\u00f6z konusu oldu\u011funda, ek sa\u011fl\u0131k sigortas\u0131 da yapt\u0131r\u0131lmal\u0131d\u0131r. Organizat\u00f6r, kendisi taraf\u0131ndan d\u00fczenlenen sigorta i\u00e7in hi\u00e7bir sorumluluk kabul etmez.<\/p>

\u00a712 Veri Koruma<\/strong><\/p>

a) Kat\u0131l\u0131mc\u0131, OM Almanya ile bir s\u00f6zle\u015fmenin imzalanmas\u0131 i\u00e7in gerekli olan ve daha sonra OM Almanya taraf\u0131ndan i\u015flenmesi gereken ki\u015fisel verileri sa\u011flar. Ki\u015fisel verilerin sa\u011flanmamas\u0131, mallar\u0131n teslimi veya veri sahibi ile ba\u015fka herhangi bir hizmetin sa\u011flanmas\u0131 i\u00e7in s\u00f6zle\u015fmenin imzalanamamas\u0131na neden olacakt\u0131r. \u0130\u015flemenin yasal dayana\u011f\u0131 Madde 6 (1) b) DSG'dir. 6 (1) b) DSGVO.<\/p>

b) A\u015fa\u011f\u0131daki Seferberlik Operasyonu departmanlar\u0131 etkinlik ba\u011flam\u0131nda ki\u015fisel verilerinizi i\u015fleyecektir: OM Almanya Konferans Ofisi (TeenStreet). Verileriniz \u00fc\u00e7\u00fcnc\u00fc taraflara da aktar\u0131labilir (\u00f6rne\u011fin k\u00fc\u00e7\u00fck grup liderleri, M&M liderleri). Verileriniz ba\u015fka herhangi bir kurulu\u015fa aktar\u0131lmayacakt\u0131r.<\/p>

\u0130lgili ki\u015fi \u00e7evrimi\u00e7i ma\u011fazada sipari\u015f i\u015flemi s\u0131ras\u0131nda bir \u00f6deme y\u00f6ntemi se\u00e7erse, ilgili ki\u015finin verileri otomatik olarak Mollie B.V.'ye iletilir. Bir \u00f6deme se\u00e7ene\u011fini se\u00e7erek, veri sahibi, \u00f6demenin i\u015flenmesi amac\u0131yla ki\u015fisel verilerin bu \u015fekilde iletilmesine izin verir.<\/p>

\u00a7 1 Registration and conclusion of contract Anyone may participate in the events organised by Operation Mobilisation e.V. (hereinafter: Organiser), provided that (1) there are no restrictions on participation in the respective programme with regard to the group of persons entitled to participate or with regard to personal requirements, in particular with regard to physical or mental constitution, age, etc., and (2) the organiser has one or more declarations from recognised reference person(s), provided this is part of the contract. The registration must be made on the organiser’s form. In the case of minors, the registration must be signed or digitally approved in the registration-process by a legal guardian. The contract is concluded when the registration fee has been received by the organiser and the written registration or the digital approval by the guardian has been submitted. \u00a0 The content of the contract is determined solely by the announcement of the event and these conditions of participation. Verbal agreements are invalid as long as they have not been confirmed in writing by the organiser. \u00a0 \u00a7 2 Terms of payment The participation fee consists of the registration fee and the remaining participation fee. Any warranty claims shall remain unaffected insofar as the changed services are defective. b) The Tour Operator reserves the right to change the advertised prices confirmed with the booking in the event of an increase in transport costs or charges for certain services, such as port or airport taxes, or a change in the exchange rates applicable to the event in question, to the extent that their increase per person or per seat affects the price, provided that there are more than 4 months between the conclusion of the contract and the agreed date. If the change in the tour price is more than 5%, the participant may cancel the contract or request a rebooking for an equivalent other event if the organiser is able to offer such a comparable event from its range without additional costs for the participant. The cancellation or rebooking request must be asserted immediately after receipt of the organiser’s statement. This possibility of rebooking also exists in the event of the cancellation of an event. \u00a0 \u00a7 4 Withdrawal of participants, rebooking, substitute person a) The participant may withdraw from the contract at any time up to the start of the event by declaration to the organiser, which must be made in writing. If the organiser terminates the contract in such a justified manner, he shall retain the claim to the participation fee; however, he must take into account the value of the saved expenses as well as those advantages he gains from any other use of the service not used, including the amounts credited to him by the service providers. b) Up to 2 weeks before the start of the event If the advertised or officially stipulated minimum number of participants is not reached, if a minimum number of participants is stated in the advertisement for the relevant event. c) Other reasons for cancellation The organiser reserves the right to cancel events at short notice if this is necessary for reasons which neither the organiser nor his service providers can influence or are responsible for, in particular due to force majeure. The participant will be informed of the cancellation immediately in writing, verbally or by telephone. \u00a0 \u00a7 6 Cancellation of the contract due to extraordinary circumstances If the event is made considerably more difficult, endangered or impaired as a result of force majeure which was not foreseeable at the time the contract was concluded, both the organiser and the participant may cancel the contract. If the contract is terminated, the organiser may demand appropriate compensation for the services already provided or still to be provided at the end of the event, unless the services are no longer of interest to the participant as a result of the termination of the contract. Furthermore, the organiser is obliged to take the necessary measures, in particular, if the contract includes return transport, to transport the participant back. The additional costs for the return transport shall be borne equally by the parties.
